Terms of Service

1. Agreement to These Terms

These Terms of Service (“Terms”) govern your access to and use of NSFW API, including our website, developer API, Playground, and related features (collectively, the “Service”).

By using the Service, creating an account, or adding prepaid funds, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Service.

2. The Service

NSFW API provides AI-powered tools for creating, editing, and transforming photos and videos through model-based API requests and the Playground. The Service may rely on third-party AI and cloud infrastructure. Output quality, processing time, and availability can vary.

We may modify, update, suspend, restrict, or discontinue any part of the Service, including features, AI models, generation options, prices, or processing providers, for operational, technical, security, legal, commercial, or other legitimate reasons. We do not guarantee that any particular functionality will remain available permanently.

Where reasonably practicable, we will provide notice of changes that materially and adversely affect users. Immediate changes or suspension may be necessary for security, legal compliance, technical operations, or provider requirements. We will not knowingly make changes that remove rights already granted by applicable law.

3. Eligibility and Accounts

You must be at least 18 years old and legally able to form a binding contract to use the Service. If you use the Service for an organization, you represent that you have authority to bind that organization.

You are responsible for your account credentials and activity. Account information must be accurate and kept current. Notify us promptly if you suspect unauthorized access.

4. Prepaid Balance, Generation Charges and Refunds

The Service uses a prepaid USD balance with four decimal places. Top-ups are currently arranged manually through the operator and recorded in the account ledger. There are no automatic subscription renewals or card payments in the current dashboard. A project marked “test” is not a free sandbox: real generations are charged.

4.1 Pricing and reservations

The server calculates a generation quote from the model and selected parameters, such as duration, resolution and prompt enhancement. Before accepting a request, we reserve the quoted amount against the available account balance. The price snapshot is fixed for that accepted request; future price changes do not alter it.

A successful generation is charged and its reserve is cleared. A generation recorded as failed, cancelled or expired releases its reserve without a generation charge. An ambiguous provider submission may remain under reconciliation with its funds reserved until the outcome is established. A reserve is a temporary hold, not a completed charge.

4.2 Requests and responsibility

Separate generation requests may each incur a charge even when their content is identical. API clients should reuse the same Idempotency-Key when retrying the same operation after a network interruption. Completed generations are not free because their appearance does not meet your expectations. You are responsible for requests made using your credentials and for your integration's retries and usage limits.

4.3 Purchases and refunds

All purchases are final and non-refundable. This includes prepaid top-ups and unused balance. Releasing a failed generation's reserve restores available account funds; it is not a refund to a payment method. Nothing in these Terms excludes rights or remedies that cannot lawfully be excluded. Prepaid funds are for purchasing our services and cannot be transferred or resold as a financial product. We may correct billing errors or address fraud, reversed payments and legal requirements through recorded account adjustments.

5. Acceptable Use and Consent

You agree not to use the Service to:

  • violate any law, regulation, court order, or third-party right;
  • upload or transform an identifiable person without their explicit, informed permission and consent, which you must be able to document in writing;
  • create or distribute non-consensual intimate imagery, sexual exploitation, harassment, stalking, defamation, blackmail, sextortion, or deceptive impersonation;
  • upload, generate, or sexualize content involving a person under 18, anyone presented as a minor, or a real, simulated, illustrated, or fictional minor;
  • use the likeness of a celebrity, public figure, or any other person without authorization;
  • create content depicting sexual violence, rape, domestic abuse, bestiality, exploitation, or trafficking;
  • promote self-harm, suicide, eating disorders, hatred, terrorism, graphic violence, or other serious harm;
  • infringe copyright, trademark, privacy, publicity, or other rights, or create fraudulent or otherwise illegal content;
  • misrepresent AI-generated output as authentic evidence in order to deceive or harm others;
  • reverse engineer, scrape, overload, disrupt, or gain unauthorized access to the Service;
  • circumvent usage or balance limits, safety measures, authentication, or other security controls;
  • systematically use the Service or its outputs to train a competing model without written permission.

We may investigate suspected abuse and preserve evidence where legally required.

5.1 Content review and enforcement

We may review, reject, restrict, remove, or disable access to User Content, generation requests, generated output, accounts, or features where we reasonably believe that:

  • these Terms, applicable law, or third-party rights have been or may be violated;
  • content or activity is unsafe, abusive, fraudulent, deceptive, or otherwise harmful;
  • another person’s identity, image, likeness, privacy, or intellectual property is used without the required rights or consent;
  • the Service is being manipulated, exploited, attacked, or used to evade restrictions;
  • action is needed to comply with payment, infrastructure, AI provider, or other platform requirements, or to protect NSFW API, users, or third parties.

We may refuse individual generation requests because of technical limitations, safety systems, applicable policies, or third-party AI provider restrictions. These rights do not mean that every request or output is reviewed or approved by us. Release of a reserve for a generation recorded as an error is described in section 4.1.

You are responsible for ensuring that your use, possession, saving, and sharing of User Content and output are lawful where you live and wherever affected people are located. Report suspected illegal or non-consensual content to [email protected]. Provide the relevant job identifier or URL and enough information to identify the issue; do not email illegal imagery. We may investigate, restrict access, preserve necessary evidence and cooperate with competent authorities where required.

6. Your Content

“User Content” includes photos, videos, prompts, text, and other material you submit. You retain ownership of your User Content.

You grant us a limited, worldwide, non-exclusive license to host, process, transmit, and display User Content only as necessary to operate the Service, fulfil your request, keep your private history, enforce these Terms, and provide support. This includes sending content to a third-party processor required by the selected workflow.

You represent that you own the User Content or have all required rights and explicit, informed consent from every identifiable adult depicted to submit and process it. You must be able to document that consent in writing. You remain responsible for User Content and for claims arising from your lack of authority or consent.

7. AI-Generated Output

Subject to these Terms, applicable law, and any disclosed third-party restrictions, you may use output generated for you for personal or commercial purposes.

AI output can be inaccurate, unexpected, non-unique, or similar to content produced for others. You are responsible for reviewing output before using, publishing, or relying on it. We do not guarantee that output is error-free or free from third-party claims.

Output is synthetic and does not establish that a depicted event occurred or that a person participated in it. A fake image can still cause real harm. Do not present output as an authentic photograph, recording, or evidence, and do not save or share intimate output without the depicted adult’s explicit consent.

8. Our Intellectual Property

The Service, including its software, branding, interface and documentation, excluding User Content, belongs to us or our licensors and is protected by intellectual property laws.

We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for its intended purpose under these Terms. No other rights are granted.

9. Third-Party Services

The Service may depend on third parties for authentication, hosting, safety checks, payments, communications, and AI processing. Their terms and privacy policies may apply to their services. We are not responsible for third-party services outside our control.

10. Disclaimers

10.1 Availability and technical interruptions

The Service depends on software, networks, cloud infrastructure, third-party AI and payment providers, and other systems. Operation may be interrupted, delayed, degraded, unavailable, or affected by errors because of maintenance, updates, capacity limits, network conditions, provider failures, security incidents, force majeure, or other circumstances outside our control.

We may temporarily restrict access to some or all of the Service for maintenance, security, legal compliance, abuse prevention, technical operations, or protection of users. We do not guarantee processing or recovery times, uninterrupted availability, or the permanent availability of any feature.

10.2 No warranties

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant uninterrupted, secure, or error-free operation, or that output will meet your expectations.

The Service is a creative tool, not a source of factual, medical, legal, forensic, or identity evidence. You must independently assess whether an intended use is safe and legal.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE AND OUR AFFILIATES, OFFICERS, EMPLOYEES, AND PARTNERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES ARISING FROM YOUR USE OF THE SERVICE.

OUR TOTAL LIABILITY FOR A CLAIM RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF THE AMOUNT YOU PAID US DURING THE THREE MONTHS BEFORE THE CLAIM OR USD $50, EXCEPT WHERE SUCH A LIMITATION IS NOT PERMITTED BY LAW.

12. Indemnification

To the extent permitted by law, you agree to indemnify and hold harmless NSFW API, its affiliates, directors, officers, employees, contractors, agents, and service providers from and against third-party claims, liabilities, damages, losses, and reasonable costs and expenses, including reasonable legal fees, arising from:

  • User Content you submit or your use, publication, or distribution of generated output;
  • your infringement or alleged infringement of intellectual property, privacy, publicity, image, likeness, or other third-party rights, including missing authority or consent;
  • your breach of these Terms or applicable law;
  • your fraudulent, abusive, or otherwise unlawful use of the Service.

You agree to cooperate reasonably in the defence of such claims. This section does not require you to indemnify us for claims caused by our own unlawful conduct, negligence, or breach of obligations that cannot lawfully be excluded.

13. Suspension, Termination, and Deletion

You may stop using the Service at any time and may request account or data deletion by emailing [email protected]. Generated files are retained for 24 hours after completion; download them before they expire. Account closure does not remove records required for billing, security or legal purposes.

We may suspend, restrict, or terminate your account or access where we reasonably believe that you have violated these Terms, engaged in fraud or abuse, infringed third-party rights, interfered with the Service, or created a legal, security, or harm risk. We may also suspend or discontinue accounts or functionality for legal or provider requirements, prolonged inactivity, discontinuation of the Service, or technical or operational reasons.

Where appropriate and legally required, we will provide reasonable notice. Immediate action may be necessary to address abuse, security incidents, or legal requirements. Upon termination, your permission to use the Service ends, and associated data may be deleted in accordance with our Privacy Policy and applicable law. Suspension or termination does not entitle you to a refund of purchases or unused prepaid balance.

Provisions that by their nature should survive termination—including ownership, disclaimers, liability limits, and responsibility for prior conduct—will survive.

14. Changes to These Terms

We may update these Terms. The “Last updated” date identifies the current version. Continued use after an update becomes effective constitutes acceptance of the revised Terms. If you disagree, stop using the Service.

15. Availability and Local Law

The Service is not offered where its use would violate applicable law. We may restrict access by location or account when reasonably necessary for legal, safety, or provider requirements. You must not use technical measures to evade such restrictions.

16. General

These Terms and the Privacy Policy are the entire agreement regarding the Service. If a provision is unenforceable, the remaining provisions remain effective. Failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition, reorganization, or asset sale.
